Sql Server Licensing

Windows Server 2000 and SQL licenses two copies legal?
We all legal licenses for both products. I'm trying to load the same software on a machine for disaster recovery, that will sit dormant until one day our primary server fails. After starting the server "inactive" in backup load the previous day and then continue execution of our business. Is it legal to have a license for 2 copies of the software itself?
Are your titles CAL or processor? If it is per processor, so there is no way to discuss, do not need Mulitple licenses. However, if you sit on CAL and then the CD does not has no relation, and not active, then you should not have a license. There is no doubt that if MS asks you to insist on both titles.
